Corps Land Use Regulations

Outline of Title 36 Code of Federal Regulations for ALLATOONA LAKE

The Allatoona Community has an obligation, as a lake community, to know and follow the rules that will protect this precious resource and the people who utilize it. This document outlines what community residents and visitors cannot do while visiting Allatoona Lake and the adjacent Corps of Engineers public land. ALLATOONA LAKE

327.02 VEHICLES

  • Parking:
  • Parking in violation of posted restrictions
  • Parking in Handicapped space

Obstructing traffic, safety hazard

  • Endangering project property or environmental features
  • Operation:
  • Operation and/or parking off authorized roadway
  • Operation of vehicle through, around or beyond restrictive sign, barricade, fence or barrier

(d) Operation in violation of posted signs:

Failure to stop, one‑way, yield

  • Speeding: In excess of 20 MPH over posted speed limit
  • Reckless operations so as to endanger persons, project property or environmental features.

Failure to keep vehicle under proper control

(f) Vehicles used other than for ingress and egress

  • Ineffective muffler and/or exhaust system

 

327.03 VESSELS

(b) Operating for fee or profit not under lease

(c) Operating vessel contrary to signs and other State and Federal Regulations:

  • Violation of NO Wake Speed Sign
  • Operation of vessel in prohibited area
  • Operating unregistered or unnumbered vessel
  • Absence of vessel registration permits card

(d) Careless, negligent or reckless operation

  • Violation of rules of the road

Improper riding in or on vessel‑ Operator/Passengers ‑ (riding on bow of vessel, etc.)

Operating vessel while intoxicated

  • Operating vessel to close to swimmers
  • Overloaded vessel
  • Operating or anchoring vessel at night without required navigation lights displayed
(d) Violation of idle speed only within 100’ rule

(e) Safety Equipment

  • Improper or inadequate personal floating devices
  • Inadequate or improper fire extinguishers, flame arrestors, ventilation, etc.
  • Children under 10 not wearing PFD

 

(f) Habitation of vessel as place of residence.

(g) Skiing, Parasail’s, Ski‑Kites, etc.

  • In a reckless, careless, negligent manner
  • In prohibited or undesignated area

Failure to comply with towing regulations no mirror or spotter ‑

  • Skier not wearing approved P.F.D.

PWC operator or passenger not wearing PFC

(h) Unauthorized mooring

  • Attaching vessel to or interfering with buoy, channel marker, or other navigational aid

(j) Ineffective muffling engine exhaust noise

327.04 AIRCRAFT

(b) Landing or taking off in undesignated area

  • Careless, negligent or reckless manner so as to endanger person or property
  • Air delivery of an object or person ‑ Parachute ‑ Mooring sea plane

 

327.05 SWIMMING

(a) Swimming, diving, snorkeling or scuba diving in unauthorized area designated by signs
(b) Failure to display diving flag
(c) Diving, jumping, or swinging from trees, bridges or other structures
327.06 PICNICKING

  • Picnicking in prohibited area designated by signs

327.07 CAMPING

(a) Camping in undesignated area

(b) Exceeding the 14 day limit

(c) Unauthorized placement of camping equipment for the purpose of reserving a campsite

(d) Digging, leveling of ground or construction of any structure
(e) Occupying or placing any camping equipment at a campsite that is “reserved” without an authorized reservation

327.08 HUNTING, FISHING AMD TRAPPING
(a) Hunting, fishing or trapping in prohibited area

327.09 SANITATION

(a) Littering, improper disposal, garbage, trash, rubbish

  • Disposing or dumping, garbage, trash, rubbish, debris, dead animals, etc.

(c) Discharge, spilling, pumping of wastes or pollutants, etc.

  • Urination, defecation

 

(d) Failure to keep campsite or picnic sites free of trash and litter during occupancy
(e) Discharge of sewage, galley waste, garbage, refuse or pollutants into project waters from any watercraft.
327.10 FIRES

(a) Unauthorized storage of gasoline and other fuel

(b) Unauthorized fire (other than grills or fireplaces)

  • Fire left unattended
  • Failure to extinguish a fire before departure
  • Burning materials that produce toxic fumes (tires, plastic, treated wood, etc.)

(c) Improper disposal of lighted smoking materials, matches or other burning material

327.11 CONTROL OF ANIMALS.

  • Dogs, cats or other pets not on 6′ leash in developed recre­ational area
  • Pets or animals on swimming beach
  • Pets or animals allowed to impede or restrict others
  • Pets barking or emitting noise which unreasonably disturb others
  • Abandonment of animals
  • Pets or animals in sanitary facilities (other than seeing eye dogs)
  • Unattended animals Failure to remove any waste produced by pet or animals

(c) Livestock in recreational area
(d) Unauthorized use of land for livestock, grazing, watering, etc.
(g) Wild or exotic pets or any pet displaying vicious or aggressive behavior

327.12 RESTRICTIONS:

  • Violation of posted and/or published restrictions or operating rules on the public use of project lands, waters, and recreation area:
  • Violation of posted or closed area
  • Violation of facility occupancy requirements
  • Violation of checkout time and visitor hours
  • Dumping polluted water onto campsite
  • Unauthorized use of vehicle between 11 p.m. ‑ 7 a.m.
  • Unauthorized use of facilities
  • Unauthorized assignment of campsite
  • Failure to place camping equipment on campsite
  • Hunting without permit
  • Violations of quiet hours
  • Any act or conduct, which interferes, impedes or disrupts another person (boisterous, rowdy, and disorderly)
  • Operating or use of any sound producing devise or motorized equipment (generators, vehicles, vessels, etc.) used to unreasonable annoy or endanger persons
  • Possession of alcoholic beverages in a posted prohibited area

327.13 EXPLOSIVES, FIREARMS, OTHER WEAPONS AND FIREWORKS
(a) Possession of a loaded firearm

  • Discharge a firearm in unauthorized area
  • Possession of loaded projectile firing device (air guns, bows and arrows, cross bows)

(b) Possession of fireworks

  • Explosion of fireworks

327.14 PUBLIC PROPERTY

  • General injury to trees, shrubs, plants, grass, and other vegetation
  • Destruction, injury, defacement or removal of public property
  • Unauthorized clearing of vegetation and/or trees resulting in minor defacement of Government property
  • Unauthorized clearing of vegetation and/or trees resulting in major defacement of Government property
  • Destruction of live vegetation and/or trees for firewood
  • Unauthorized alteration of Government property with earth moving equipment
  • Tampering, marring, destroying signs
  • Destruction, alteration, tampering with boundary marker
  • Cutting or gathering of trees or parts of trees or removal of wood from project land

(d) Use of metal detector in prohibited areas

327.15 ABANDONMENT
(a) Abandonment of personal property of any kind
(b) Abandonment of vehicle, vessel, boat trailer
(c) Personal property placed on Federal lands adjacent to private residence

327.16 LOST AND FOUND
(a) Failure to turn in lost and found articles

327.17 ADVERTISING Billboards, signs, markers, audio devices, etc.

327.18 COMMERCIAL ACTIVITIES
(a) Sell or expose articles for sale
Unauthorized commercial soliciting
Engaging in unauthorized commercial activity

327.19 PERMITS

  • Failure to comply with conditions of any permit

327.20 UNAUTHORIZED STRUCTURES

  • Construction, placing or continued existence of any structure on Government property

327.21 SPECIAL EVENTS
(a) Failure to obtain permission

  • Charging a fee for special event

327.22 UNAUTHORIZED OCCUPATION

  • Occupying land, building or vessel for residence
  • Unauthorized agricultural purposes

327.23 RECREATIONAL USE FEES

  • Failure to pay fee
  • Failure to properly display passes/receipt
  • Fraudulent use of Golden Age or Golden Access Passport

327.24 INTERFERENCE
(a) Physical interference with an officer

  • Use of profanity towards an officer

(b) Failure to provide proper identification for an officer

    • Failure to comply with a lawful order
    • Failure to stop for an officer
